Terms of Service

It is mutually agreed that the following terms of agreement form an integral part of this Contract. It is understood that Aly Lee Photography is the exclusive official photographer retained to perform the photographic services requested on this Contract.

Payment + Pricing: Appointment is not confirmed until a 50% non-refundable retainer has been paid via Venmo or Zelle. No images will be taken of the client until full payment has been paid to the photographer at start time of session appointment.
The charges in this Contract are based on Aly Lee Photography’s standard Price List. This price list is adjusted periodically and future scheduled sessions shall be charged at the prices in effect at the time when the order was placed, regardless of the pricing charged at any previous sessions.
Cancellation: Upon signature of this contract, Aly Lee Photography shall reserve the time and date agreed upon by both parties. Clients agree to cancel no less than 48 hours prior to scheduled appointment time. In the event of cancellation, the retainer will not be refunded but client may reschedule their appointment with no additional deposit fee.
Weather: If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of Aly Lee Photography, photographer may elect to use an alternate location or to reschedule the portrait session. If client so choses to move forward with appointment against the professional guidance of the photographer, client will not be able to get a “make-up mini” session if not pleased with the quality of the images due to the undesirable weather conditions.
Travel: Scheduled sessions outside of Oakdale or Tracy, California will incur a travel charge of $20 per 30 minutes of travel roundtrip. Overnight accommodations will be charged to the client if necessary and location is more than 150 miles outside of Oakdale, California or Tracy, California. 
Time frame: Client is responsible for ensuring prompt arrival for scheduled session timeframe. If client is late to the appointment, client will lose the time and not be able to extend appointment unless purchasing additional session at $100 per 30 minutes added.
Limitation of Liability: In the unlikely event that Aly Lee Photography cannot perform this Contract due to cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, or otherwise lost or damaged without fault on the part of the Photographer. In the event Aly Lee Photography fails to perform for any other reason, Aly Lee Photography shall not be liable for any amount in excess of all monies paid. 
Quality Expectations: If client expectations are not met after the final product is received, the client may request a “make-up mini” session to capture the number of edits at maximum of 10, that were not up to standard. If client is fully dissatisfied, a refund will not be permitted, additional full session may be offered at the discretion of Aly Lee Photography. The Client must notify Aly Lee Photography within 24 hours of receiving the final edits to express dissatisfaction; should the Client fail to meet that time constraint, Aly Lee Photography is not obligated to perform “make-up mini” session to meet said standards or return any monies collected for service performed.
Image Selection: As a professional Aly Lee Photography reserves the rights to select the best quality of images to meet client expectation of service. Clients will not be provided proofs to keep or select digital images. Aly Lee Photography promises to only select the best quality images for client.
Rights to photos: Aly Lee Photography reserves the right to use images created under this contract for advertising, display, publication or other purposes. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend Aly Lee Photography in the event of litigation arising out of such use. Raw digital files and previews remain the exclusive property of Aly Lee Photography.
Client is aware that emailed edits are only downloadable for 7 days, online albums are only accessible for 60 days, and it is not the responsibility of Aly Lee Photography to keep digital copies of edits past 80 days of service date; if Client loses or deletes all copies of edits past maximum timeframe, digital images will not be resent and provided to client.
